In this Privacy Policy, We use the terms, “We”, “Us” and “Our” to refer to any entity that forms part of the Muscle Republic Group, including Muscle Republic Pty Ltd ACN 610 216 512, MSCR Pty Ltd ACN 635 869 751 and any of their related bodies corporate. 

PURPOSE OF THIS PRIVACY POLICY

Your privacy and maintaining the confidentiality of your Personal Information is important to Us. We are committed to maintaining the security of Personal Information provided to Us by individuals who access and use Our website at https://musclerepublic.com, Our mobile application and any of our social media platforms (collectively, Platform) as well as individuals who purchase products from Our Platform.

The purpose of this privacy policy (Privacy Policy) is to set out how We collect, store, use and disclose Personal Information and what steps We take to comply with the Privacy Act 1988 (Cth) and its amendments (Privacy Act) and other relevant laws.

Your continued use of Our Platform will be regarded as your acceptance of Our Privacy Policy. By continuing to use Our Platform or purchase Our products, you acknowledge and agree that We may collect, hold and share Personal Information about you as described in this Privacy Policy.

PERSONAL INFORMATION WE COLLECT

When you visit the Platform, We automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Platform, We collect information about the individual web pages or products that you view, what websites or search terms referred you to the Platform, and information about how you interact with the Platform (Device Information).

  • when you use or buy Our products or services from the Platform;
  • when you provide Us, or you offer or apply to supply Us, with goods or services;
  • when you provide information to Us in any way (including by completing a form, disclosing information over the phone, via email or live chat, or providing Us with a business card);
  • when you enter into any of Our competitions or promotions, including by way of any social media platform;
  • when you request information about Us, Our products or Our services;
  • when you provide feedback to Us;
  • when you visit or fill in a form on the Platform;
  • when you visit any premises from which We operate;
  • when you (or your employer) provide that information to Us in the course of conducting or administering Our relationship with you, or when you are carrying out activities in connection with Our business operations;
  • when you submit a job application to Us;
  • when you otherwise contact Us by telephone, fax, email, social media, post, in person, or live chat; and
  • where We are otherwise required or authorised by law to do so.

If you choose not to provide your Personal Information to Us for the purposes set out in this Privacy Policy, We may not be able to provide you with the requested information, products or services to effectively conduct Our relationship with you.

We collect Device Information using the following technologies:

Third party content (eg social media links) 

Some of the content on Our Platform includes applications made available by third parties, such as social media buttons or links that allow you to share content or links to Our Platform  through the relevant third party platforms. These third party applications themselves may facilitate the collection of information by those third parties, through your interaction with the applications and sometimes even if you do not interact directly with them. We are not responsible for the technical operation of these applications or the collection and use practices of the relevant third parties. WHAT INFORMATION DO WE COLLECT

When you make a purchase or attempt to make a purchase through the Platform, We collect certain information from you, including your name, billing address, shipping address, payment information (including debit or credit card numbers, Paypal or AfterPay, bank details), email address, phone number and geographical location (Order Information). 

In addition to Order Information and Device Information,  We may also collect the following information through email sign ups, job applications or any other means of communication with Us:

  • name;
  • date of birth;
  • contact details, including telephone numbers (landline and/or mobile);
  • current address (including postal address);
  • email address
  • gender
  • payment details, such as your debit or credit card, Paypal or AffterPay, bank details
  • geographical location
  • your IP address (this is your computer’s individual identification number) which is automatically logged by Our web server. This is used to note your interest in Our Platform;
  • photographs and/or images of you from camera footage you have provided to Us;
  • consumption habits and preference information from social media accounts and profiles;
  • occupation and employment details including employment status and any previous work experience; and
  • information from or in connection with your resume or job application if you apply for a position with Us.

When We talk about “Personal Information” in this Privacy Policy, this includes both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that We collect generally to fulfill any orders placed through the Platform (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, We may use any Personal Information provided to Us to:

  • establish your identity;
  • set up, administer and manage Our products and systems including the management and administration of an account with Us;
  • provide Our products to you;
  • communicate with you (including for direct marketing purposes which includes providing you with information on Our latest events, special offers and news);
  • screen Our orders for potential risk or fraud;
  • when in line with the preferences you have shared with Us, provide you with information or advertising relating to Our products or services;
  • in the case of Device Information, help Us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize Our Platform (for example, by generating analytics about how Our customers browse and interact with the Platform, and to assess the success of Our marketing and advertising campaigns);
  • advertise Muscle Republic across social networks (including by Facebook, TikTok and Instagram retargeting). Facebook and Instagram retargeting will display relevant advertisements tailored to you based on areas of the Platform that you have visited, by placing a cookie on your device. This cookie does not give Us access to your device. The cookie is used to allow Us to identify whether an individual has visited a page and, if so, show them related advertisements. Facebook and Instagram retargeting allows Us to tailor Our marketing to better suit your needs and only display ads that are relevant to you; and
  • to Comply with legal requirements.

We may use third parties who are also bound by privacy policies to carry out certain activities, such as processing and sorting data, monitoring how customers use the Platform and issuing Our emails for Us.

We reserve the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law, but We have no obligation to monitor the use of the Platform or to retain the content of any user session.

You consent to Us using your Personal Information in the above ways and as set out in this Privacy Policy.

We may otherwise collect, use or disclose your Personal Information where the collection, use or disclosure is:

  • in accordance with this Privacy Policy or any agreement you enter into with Us, or
  • required or authorised by law, including without limitation the Australian Privacy Principles under the Privacy Act.

STORAGE AND SECURITY OF PERSONAL INFORMATION HELD BY US

We aim to keep your Personal Information secure. Any Personal Information that is collected via Our Platform or which is held on Our systems are protected by safeguards including physical, technical (firewalls, SSL encryption etc) and procedural methods.

Whilst We take reasonable measures, no data transmission over the internet can be guaranteed as fully secure and accordingly We cannot guarantee or warrant the security of any information you send to Us over the internet. You submit information over the internet at your own risk.

We do not collect sensitive or financial information about Our users via Our Platform.

If We find that We no longer require or have no further need for your Personal Information We may remove it from Our systems and securely destroy all record of it.

SHARING YOUR PERSONAL INFORMATION

Finally, We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful requests for information We receive, or to otherwise protect Our rights.

OVERSEAS DISCLOURES

Some of your Personal Information may be disclosed, transferred, stored, processed or used overseas by Us, or by Our third party service providers. This may happen if:

  • Our offices or related entities are overseas;
  • We outsource certain activities overseas;
  • transactions, information, services or products have an overseas connection; or
  • Our computer systems including IT servers are located overseas.

You consent to the collection, use, storage, and processing of your Personal Information outside of Australia as set out in this Privacy Policy.

In particular, your Personal Information may be disclosed to third parties in the United States of America and such other countries in which those parties or their, or Our, computer systems may be located from time to time, where it may be used for the purposes described in this Privacy Policy. In these circumstances, you consent to the collection, use, storage and processing of your Personal Information in those countries, without Us being responsible under the Privacy Act for such use (or for any breach). Where such parties are located overseas, you may have rights to enforce such parties’ compliance with applicable data protection laws, but you may not have recourse against those parties under the Privacy Act in relation to how those parties treat your Personal Information.

By entering your phone number in the checkout and initialising a purchase through Our Platform, subscribing via Our subscription form or a keyword, you agree that We may send you text notifications (for your order, including abandoned cart reminders) and text marketing offers. You acknowledge that consent is not a condition for any purchase.

If you wish to unsubscribe from receiving text marketing messages and notifications use the unsubscribe link provided within any of Our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests will not be accounted as a reasonable means of opting out. DO NOT TRACK

Please note that We do not alter Our Platform’s data collection and use practices when We see a Do Not Track signal from your browser.

YOUR RIGHTS

You can ask Us to update your Personal Information by emailing precise details of your request to customercare@musclerepublic.com

  • You can ask Us not to send you future marketing communications. You can do this by clicking on the 'Unsubscribe' or subscription preferences link in a direct marketing email that you have received from Us.
  • You can also email Us at customercare@musclerepublic.com. We will then suppress your data from all direct marketing, although We will still keep it for processing your order and fulfilling customer service requests and after sale obligations. Alternatively, you can post your request to the address at the end of this Privacy Policy.
  • You also have the right to request a copy of any Personal Information We hold about you. To do this, email Us or write to Us using the above contact information.

DATA RETENTION

When you place an order through the Platform, We will maintain your Order Information for Our records unless and until you ask Us to delete this information.

MINORS

The Platform is not intended for individuals under the age of 18. If you are under 18 years of age, you must not use the Platform.

COMPLAINTS ABOUT PRIVACY

If you feel that We have not respected your privacy or that We have conducted Ourselves inconsistently with this Privacy Policy, please contact Our customer service team as per the contact details at the end of this Privacy Policy and advise Us as soon as possible. We will endeavour to acknowledge your request and investigate your queries and complaints within a reasonable period of time depending on the complexity of the complaint.

It would assist Us to respond to your complaint promptly if it is made in writing. Please detail information relevant to your complaint.

We will notify you of the outcome of Our investigation. If you are not satisfied with the outcome received, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) who can be contacted at either www.oaic.gov.au or by telephone on 1300 363 992.

UPDATES TO THIS PRIVACY POLICY

We may, from time to time, review and update this Privacy Policy at Our sole discretion, including to take into account new laws, regulations, practices and technology. If We do so, We will post the updated version on the Platform and all Personal Information held by Us will be governed by the most recent Privacy Policy, posted on Our Platform.

If any of the Personal Information We hold about you is incorrect, inaccurate or out of date you may request that We correct the information. If appropriate We will correct the Personal Information. Your request will be dealt with within a reasonable time and if We refuse to provide you with access to, or correct, the information, We will notify you of reasons for the refusal to the extent required and how you may complain about the refusal. 

We may need to consult with other entities as part of Our investigation.

You have the right to withdraw consent for the processing of your Personal Information at any time.

We may use information collected from or about you for the purpose of providing you with current information about special offers you may find of interest, changes to Our organisation, or new products or services being offered by Us or any company with whom We are associated.
