TERMS & CONDITIONS

This website is owned and controlled by the Muscle Republic Group, including Muscle Republic Pty Ltd ACN 610 216 512, MSCR Pty Ltd ACN 635 869 751, and any of their related bodies corporate (Muscle Republic, We, Us or Our). You acknowledge that your use of every website, social media account or mobile application (collectively, Platform) owned or controlled by Muscle Republic is an indication of your acceptance of these Terms and Conditions (Terms) and Our Privacy Policy. These Terms constitute the whole agreement between you and Muscle Republic relating to your use of, and access to, the Platform, including your use of the Platform to complete any orders or transactions.

We reserve the right to vary or modify the Platform and these Terms from time to time at Our sole discretion and without notice. Any amendments will come into effect immediately and automatically. Any continued use by you of the Platform will constitute an acceptance of those variations and modifications. These Terms are effective until terminated by Us, which We may do at any time without notice to you. In the event of termination, all restrictions imposed on you by these Terms and limitations of liability set out in these Terms will survive.

DISCLAIMERS

Some legislation such as the Australian Consumer and Competition Act 2010 (Cth) and other similar consumer protection laws and regulations in other countries may confer you with rights and remedies relating to the provision of goods or services to you by Us via the Platform which cannot be excluded, restricted or modified (Statutory Rights). We exclude all conditions and warranties implied by custom, law or statute except for your Statutory Rights.

Except for your Statutory Rights and with respect to the Platform:

  • All material on the Platform and Our goods and services are provided to you without warranties of any kind, either express or implied;
  • We expressly disclaim all warranties of any kind including but not limited to warranties of acceptable quality and fitness for a particular purpose;
  • We do not warrant that the functions contained in any material on the Platform or your access to the Platform will be uninterrupted, without delay, error-free, omission-free or free of viruses; and
  • We do not warrant or make any representation regarding your access to, or the results of your access to, the Platform including its correctness, accuracy, timeliness, completeness, reliability or otherwise.

To the extent permitted by law, including but not limited to any act or omission on your part, we will not be liable for any loss, damage, costs or expense whether direct, indirect, incidental, special and/or consequential, including loss of profits, suffered by you or claims made against you which result from any use of, or access to, or any ability to use or access, the Platform or Our goods or services.

COMMUNICATION:

In accordance with applicable laws, and where you agree, we may send you electronic communications in the form of email and/or SMS at the email address and/or mobile number nominated by you. You may opt-out of receiving these communications at any time using the instructions set out in the communication. Please note that it may take up to [five (5)] business days for your request to be processed. If you opt-out, you may still receive communications from Muscle Republic about your account or any services you have asked to receive by Muscle Republic. You acknowledge and agree that any electronic communication in the form of such email, SMS or posting on the Platform shall satisfy any legal requirement that such communication be in writing.

You agree that Muscle Republic may use and/or disclose information consistent with Our Privacy Policy.

PRIVACY

Your privacy and maintaining the confidentiality of your personal information is important to Us. Please read Our separate Privacy Policy to understand more about how we protect your personal information. All personal information (including information about your access to the Platform) will be collected and treated in accordance with Our Privacy Policy.

ORDERS:

  • While we try to ensure that all details, descriptions and prices that appear on the Platform are accurate, errors may occur. We may choose to not fill any order (or part of any order) you have placed where the Platform contains errors or inaccuracies, including, but not limited to, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. If we choose to not fill any order (or part of any order) you have placed, we will refund you the monies you have paid to Us relating to the goods or services we have chosen not to provide.
  • Where your order relates to goods:
  • Risk in the goods will pass to you when we place the goods in the post or with another delivery service; and subject always to Our right not to fill any order (or a part of any order) as set out above, title to the goods will only pass to you once you have paid Us the full price relating to the goods (as specified in your order).

To place an order:

  • Find products you wish to purchase on the Platform and add to checkout cart.
  • Select size and quantities required and proceed to checkout.
  • Customers are responsible for supplying the proper and correct address information for orders.
  • Once an order has been placed through Our online checkout system on the Platform, a confirmation email will be sent to your nominated email address. Once your order has been shipped, a tracking number will be delivered to the same email address.
  • Muscle Republic is not responsible for any failure of the delivery carriers to deliver your order, including when an order is misplaced, lost or stolen during transit. Responsibility is held with Our delivery carriers however Muscle Republic will do everything possible to assist.
  • Should, for some unforeseen reason, we become unable to fulfil your order, Muscle Republic will send an email as soon as possible to the supplied address and explain the issue.
  • Please note, once you have placed your order we are not able to amend the items. If you discover that there has been a mistake with your order once it has been placed, you may request the order to be cancelled or amended. However, we cannot guarantee that we can do this prior to the order being dispatched.
  • Should the item you have ordered not be available or in stock we will contact you to confirm restock timing.
  • We are unable to deliver to PO Boxes. Therefore please provide full residential address. If shipping to a business address, please include full trading name of business, including suite, unit and building number along with delivery instructions.

DISCOUNT CODES AND PROMOTIONS:

From time to time, Muscle Republic may offer promotions, discounts or other special offers (Promotions). All Promotions are subject to these Terms, as well as any specific terms and conditions that may be provided with each Promotion. For detailed information about Our current Promotions, including eligibility criteria, offer details, and expiration dates, please visit Our Promotions and Discounts landing page here. By participating in any Promotion, you agree to comply with the terms outlined in these Terms and any Promotion-specific terms and conditions.

Please note the following:

  • Promotions may be limited to certain products, collections or order totals, and may require a minimum purchase. Promotions may also be subject to eligibility criteria such as new or existing customer status.
  • All discount codes must be entered at checkout in the discount code box and before payment details have been submitted. Discount codes cannot be applied retrospectively once an order has been placed.
  • Only one discount code can be used per order. A discount code and a rewards code cannot be used in the same order.
  • Our software does not allow Us to manually apply discount codes to orders or adjust prices once orders are finalised.
  • A discount code cannot be used when processing a return in Our returns portal. We do offer a $15 credit to shop now (Shop Now Credit) to use immediately once your return has been processed. However you are unable to add any further discounts or bundles in addition to the Shop Now Credit.
  • If you would like to receive a store credit in exchange for your returned products and use this in conjunction with any Promotion, you will need to place a new order via Our Platform using the store credit and apply the relevant discount code or claim the bundle offer. However you will forfeit the Shop Now Credit.
  • No bundle offers can be applied during a product exchange and the items in your order will be charged at their full price. If you would like to purchase a bundle, you will be able to select a store credit in your return and then use that credit to shop and claim the bundle on Our Platform. If you select 'Return for $ Refund' option you will not receive the Shop Now Credit.
  • Discount codes and promotions cannot be used in conjunction with E-Gift Card purchases.
  • Each Promotion will be valid for a limited time only, as specified in the promotional materials or on the Promotions and Discounts landing page. The availability of Promotions is subject to change at any time, including but not limited to promotional and sale periods.
  • Certain products may be excluded from Promotions. Please check the Promotions and Discounts landing page for more details.
  • Muscle Republic reserves the right to refuse, suspend, or cancel any Promotion if we believe it is being used fraudulently, abusively, or in violation of these Terms.

IMPORT TAXES/DUTIES & CUSTOMS CHARGES:

  • Orders delivered to countries outside of Australia may be subject to additional custom duties and taxes. The amount of these duties and taxes, if any, will vary depending on the destination country and are the ultimate responsibility of the purchaser.
  • Muscle Republic are not responsible for any duties and taxes which are determined by the relevant customs agency of the purchaser’s destination country. Due to these charges being determined by the customs agency, we are unable to advise you whether any duties will apply and/or of their final cost.
  • The final value of your order does not include any additional duties required of which the carrier will inform the customer.
  • If you refuse to pay the applicable duties and taxes to release your order, the order will subsequently be returned to Muscle Republic and refunded. A shipping and handling fee may be deducted from your refund.
  • We suggest that you contact your local government or customs before placing your order to obtain the correct information regarding any applicable duties or taxes.

PRICES:

Muscle Republic reserve the right to change the price of Our products at any time without notice. Any orders placed prior to this change cannot be amended to the revised price. The price of the products at the time of checkout is the final price.

CURRENCY EXCHANGE:

  • Customers must select their preferred currency from the currency convertor feature in the top tool bar.
  • Exchange rates fluctuate depending on the daily foreign exchange market. Muscle Republic is not responsible for any fluctuation in prices as a result.

E-GIFT CARDS:

  • Muscle Republic is unable to apply a Gift Card to an order that has already been processed and completed. 
  • Gift Cards are not (in part or in full) refundable or redeemable for cash.
  • The expiration period for your Gift Card is set at three (3) years from the date it was issued, and there are no extensions beyond this timeframe. 
  • Any remaining balance on the Gift Card after it expires will not be refunded, credited, or moved to a new gift card.
  • Your Gift Card entitles you to purchases up to the sum specified on the card. If you would like to make a purchase of goods for an amount that exceeds the value on your Gift Card, you must pay the excess using another payment method.
  • Gift Cards can only be purchased in the amounts of $20, $50, $100, $150, $200, $300 or $500.
  • Your Gift Card cannot be used to purchase another Gift Card.
  • Muscle Republic is not liable for any loss, theft, or damage to Muscle Republic Gift Cards, and is not obligated to replace or refund the value of any lost, stolen, or damaged Gift Cards. 
  • Gift Cards are only valid if purchased from Muscle Republic. A Gift Card is neither valid nor acceptable, and We will not be held liable, if it is obtained from unauthorised sellers or resellers. Gift Cards obtained or purchased from non-Muscle Republic sources may be invalid or have a lower redeemable balance or value than the unauthorised vendor represented. Muscle Republic is not obligated to honour invalid Gift Cards or balances, or values that have been incorrectly represented or are incorrect.

RETURNS POLICY:

Returns and Exchanges:

  • Although We hope you love all your items from Muscle Republic, should you not be 100% satisfied with your new apparel We have a few return options available. Our returns portal makes it easy to process your return and gives you the flexibility to decide how you want your return processed. All you will need is your order number and delivery post code. For further information or to process your return, please click here.
  • If your return is eligible for a refund, the refund will be processed back to the original form of payment.
  • Items must be in original condition - unworn, unwashed, with all tags still attached and in saleable condition. Please be careful when trying on items for the first time as We will not accept returns of any product that has deodorant, makeup, tan stains, or any marks at all and it will be reshipped back to you.
  • Orders can be returned within 30 days for an exchange or store credit. Full price items can be returned within 15 days a refund. Refund requests will have a $7.00 shipping fee deducted from the refund of the total return.
  • We aim to process returns within 3 business days of receiving your items. We will send you an email with the details of your processed return.
  • Final Sale Items are final and cannot be exchanged, returned for a refund, or store credit, other than in the event of them being faulty.
  • International returns can be returned for Store Credit or Refund only, sadly no exchanges. Please see the INTERNATIONAL RETURNS section here for further information and click the link to start your return in our returns portal.

Sitewide Sale Returns Policy:

Items purchased during sitewide sales can be returned for a store credit or exchange only, no refunds. You will be able to return items for an exchange or store credit within 30 days of delivery with Our free return label. Refunds will not be available during any sitewide sale for any items purchased!

Final Sale items that have been further discounted during a sitewide sale cannot be returned for a refund, or store credit, other than in the event of them being faulty.

If you purchase multiple sizes in the same product, unfortunately We are unable to make exceptions for refunds and duplicate items will still only be eligible to be returned for a store credit or exchange only. Due to the large volume of sales, We are unable to guarantee your exchange items will be available upon processing, as items do sell out quickly so We  recommend selecting the instant exchange option if you want to secure your item.

If you select an exchange and your return is delivered back to Our warehouse and processed after the sitewide sale has ended, unfortunately We are unable to honour the new item at the discounted price and it will be charged at full price. In this case, We do recommend selecting the instant exchange option or a store credit. If you have selected a new item that is not an even price exchange to the original item, a store credit will be processed instead so the correct amount is provided back to you to shop with.

Faulty Products:

Should you receive a faulty product, you can request for a review on the returns and exchange portal. You will need to provide a clear photo of the faulty item and upload it into the warranty claim. We will be able to assess and replace the item as soon as possible. If the item is sold out, a store credit will be issued to you.  If your faulty return request is not approved, We will reach out with further details.

Warranty periods or time frames vary per item and are effective from the date of purchase.

TRACKING:

All orders are tracked and customers will receive an email confirming the tracking number once the order has been dispatched.

WORLDWIDE SHIPPING RATES:

We have multiple options for international deliveries, depending on where you are situated in the world. 

Please note, all timeframes listed below are estimates only and can vary depending on country and during peak seasons, such as sale & holiday periods. Whilst most of Our orders are arriving as per the below timeframes, the estimated delivery timeframes will vary based on destination and are subject to change in relevance to severe weather, pandemic conditions or other circumstances beyond Our control.

Upon receiving your items

It is your responsibility to check the delivery (if applicable) before signing for and accepting it. Any discrepancy in the number of items received must be noted on the consignment there.

The name of the person receiving the goods must be clearly legible at all times. It is your responsibility to check the goods to the invoice within 48 hours of delivery and contact Customer Service if there is a discrepancy within the 48 hours.

Please provide your order number, email confirmation and tags on the items received and Our Customer Service team will respond as soon as possible. 

LIABILITY AND INDEMNITY

To the maximum extent permitted by law, Muscle Republic will not be liable for any loss or damage which may arise as a result of the use of the Platform, its content or reliance on the information on it, or the use of Our goods or services, including without limitation any direct, indirect, special, incidental, consequential or punitive damages, whether arising out of contract, statute, tort or otherwise. This includes, but is not limited to, the transmission of any computer virus. Your use of, or reliance on, any information or materials on the Platform, or Our goods or services, is entirely at your own risk, for which We shall not be liable.

To the maximum extent permitted by law, you agree to indemnify Us, and hold Us harmless, against any liability suffered or incurred by Us arising from or in connection with your use of the Platform, Our goods or services or any breach of these Terms or any applicable laws by you. This indemnity is a continuing obligation, independent from the other obligations under these Terms, and continues after termination of these Terms.

COPYRIGHT, TRADEMARK AND RESTRICTION OF USE

The Platform and Our goods and services contain material which is owned by or licensed to Us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks, images and graphics. You are not permitted to reproduce the documents, information, or materials on the Platform or any of Our intellectual property for any purpose, including the purposes of sale or the use by any third party. In particular, you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for download from time to time on the Platform or any of Our intellectual property. You may not, except with Our express written permission, distribute or commercially exploit the content of the Platform or any of Our intellectual property. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.

Muscle Republic expressly reserves all copyright and trademark in all information and material on the Platform and in Our goods and services and We reserve the right to take action against you if you breach any of these Terms.

TRANSMISSION OF INFORMATION

All information transmitted over the internet is susceptible to monitoring and interception. You will bear the risk of transmitting information to Us in this manner. We do not guarantee or warrant the security of any information transmitted to Us in this manner and We will not be liable for any loss, harm or damage suffered by you as a result of transmitting information to Us in this manner.

CONDUCT

The Platform and Our goods and services may be used only for lawful purposes, and you are prohibited from posting any unlawful, harmful, threatening, abusive, harassing, defamatory, discriminatory, or obscene material of any kind on the Platform or otherwise using Our goods or services in an unlawful manner.

You are prohibited from accessing or using the Platform or Our goods or services in any way that competes with Our business or that tampers with or modifies it, knowingly transmits viruses or other disabling features, or damages or interferes with the Platform or Our goods or services.

THIRD PARTY WEBSITES AND SOFTWARE APPLICATIONS

The Platform may contain links to websites or other media owned and operated by third parties. Links to third party websites or other media have been provided solely for your convenience and to enable you to obtain further information about other organisations and activities which may be of interest to you. We make no representations and provide no warranties regarding the accuracy or suitability of, and accept no responsibility or liability for, anything you obtain via these third-party websites or other media. A link from the Platform does not imply Muscle Republic’s endorsement, approval or agreement with the views of those third-party websites or other media.

By linking to sites or other media operated by third parties, We are not authorising the reproduction of any materials on such sites or other media, as such material may be the subject of intellectual property rights of third parties.

GOVERNING LAW AND JURISDICTION

The use of the Platform and Our goods and services, and these Terms, are governed by the laws of New South Wales. You submit to the exclusive jurisdiction of the courts of New South Wales for determining any dispute concerning these Terms.

If a provision of these Terms is held to be void, invalid, illegal or unenforceable, that provision must be read down as narrowly as necessary to allow it to be valid or enforceable. If it is not possible to read down a provision (in whole or in part), that provision (or that part of that provision) is severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions in these Terms.
